Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Withdrawal Period: the period during which the consumer can exercise their right of withdrawal;

Consumer: the natural person acting for purposes outside their trade, business, craft, or profession and entering into a distance contract with the trader;

Day: calendar day;

Ongoing Transaction: a distance contract for a series of products and/or services where delivery and/or collection obligations are spread over time;

Durable Data Carrier: any means that allows the consumer or trader to store information addressed personally to them in a way that allows future consultation and unchanged reproduction;

Right of Withdrawal: the consumer’s right to withdraw from the contract within the withdrawal period;

Trader: the natural or legal person offering products and/or services at a distance to consumers under the brands Faith & Eva × Maison Léa & Lou;

Distance Contract: a contract concluded within an organized system for distance selling of products and/or services where one or more techniques of distance communication are used up to and including the conclusion of the contract;

Technique of Distance Communication: any means that can be used to conclude a contract without the consumer and trader being physically present in the same location;

General Terms: these general terms and conditions of the trader.

Article 3 – Applicability

These general terms and conditions apply to every offer made by the trader and to every distance contract and order between the trader and the consumer.

Before a distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the conclusion of the contract where the terms can be consulted and that they will be sent free of charge upon request.

If the distance contract is concluded electronically, the terms will be made available electronically in a way that allows the consumer to store them on a durable data carrier.

If additional product or service conditions apply, the consumer may always rely on the provision most favorable to them in the event of conflicting terms.

If any provision of these terms is found to be invalid or void, the remaining provisions will remain in full force and effect.

Situations not covered by these terms will be interpreted in the spirit of these general terms and conditions.


Article 4 – Offers

If an offer has a limited validity period or is subject to conditions, this will be clearly stated.

All offers are non-binding. The trader reserves the right to modify and adapt offers.

Offers include a complete and accurate description of the products and/or services. Images are intended to represent the products as accurately as possible. Obvious errors or mistakes in the offer are not binding on the trader.

Each offer contains sufficient information to make clear to the consumer what rights and obligations are attached to acceptance of the offer, including in particular:

  • the price including taxes;

  • any delivery costs;

  • how the contract will be concluded;

  • whether the right of withdrawal applies;

  • the method of payment, delivery, and performance;

  • the period for accepting the offer;

  • whether the contract will be archived and how it can be accessed;

  • the languages available for the contract;

  • any applicable codes of conduct;

  • the minimum duration of the distance contract in the case of ongoing transactions.


Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and complies with the stated conditions.

If the consumer has accepted the offer electronically, the trader will promptly confirm receipt electronically. Until this confirmation is received, the consumer may dissolve the agreement.

The trader will take appropriate technical and organizational measures to secure electronic data transfer and online payment.

The trader may, within legal limits, verify whether the consumer can meet payment obligations. If the trader has valid grounds not to enter into the agreement, the trader may refuse an order or attach special conditions.

Upon delivery, the trader will provide the consumer with the legally required information on a durable data carrier.


Article 6 – Right of Withdrawal

For product purchases, the consumer has the right to withdraw from the agreement within 14 days without giving reasons.

The withdrawal period starts on the day after the consumer, or a representative designated by the consumer, receives the product.

During the withdrawal period, the consumer must handle the product and packaging with care and may only unpack or use the product to the extent necessary to determine whether they wish to keep it.

If the consumer exercises the right of withdrawal, the product must be returned with all supplied accessories and — if reasonably possible — in the original condition and packaging, in accordance with the trader’s instructions.

The consumer must notify the trader within 14 days of receipt and return the product within 14 days after notification. Proof of timely return is required.

If the consumer fails to meet these deadlines, the purchase becomes final.


Article 7 – Costs in Case of Withdrawal

The consumer bears the direct cost of returning the product unless stated otherwise.

If the consumer has paid an amount, the trader will refund this amount as soon as possible, but no later than 14 days after withdrawal, provided the product has been received or proof of return has been supplied.


Article 8 – Exceptions to the Right of Withdrawal

The right of withdrawal may be excluded for products clearly indicated in the offer, including but not limited to:

  • products made to consumer specifications;

  • products of a personal nature;

  • products that cannot be returned by nature;

  • perishable products;

  • products subject to financial market fluctuations;

  • newspapers and magazines;

  • sealed audio/video/software where the seal is broken;

  • hygiene products where the seal is broken.


Article 9 – Prices

Prices remain valid during the stated validity period of the offer, except for price changes due to VAT adjustments.

Products or services subject to financial market fluctuations may have variable prices.

All prices are subject to typographical errors. The trader is not obliged to honor incorrect pricing.

Import duties and taxes (if applicable) are the responsibility of the consumer.


Article 10 – Compliance and Warranty

The trader guarantees that products comply with the agreement, the specifications stated in the offer, reasonable usability requirements, and applicable legal provisions.

Any defects or incorrectly delivered products must be reported within 14 days of delivery.

The warranty does not apply in cases of:

  • unauthorized modifications or repairs;

  • improper use or handling;

  • normal wear and tear;

  • damage caused by external factors or regulatory changes.


Article 11 – Delivery and Execution

The trader will exercise the utmost care when receiving and executing orders.

Products are shipped from international fulfillment warehouses to offer competitive pricing.

The place of delivery is the address provided by the consumer.

Orders will be processed promptly and at the latest within 30 days, unless a different delivery period has been agreed.

If delivery is delayed or an order cannot be fulfilled, the consumer will be informed within 30 days and may dissolve the agreement without charge.

The risk of damage or loss remains with the trader until delivery to the consumer or their designated representative, unless otherwise agreed.


Article 12 – Duration Transactions: Duration, Termination, and Extension

Consumers may terminate agreements in accordance with applicable law and the conditions stated in the contract.


Article 13 – Payment

Unless otherwise agreed, payment must be made promptly via the offered payment methods at checkout.

The consumer must immediately report inaccuracies in payment details.

In case of non-payment, the trader is entitled, subject to legal restrictions, to charge reasonable costs made known in advance.


Article 14 – Complaints Procedure

Complaints about the performance of the agreement must be submitted to the trader within a reasonable time after the consumer has discovered the defect.

Complaints submitted will be answered within 14 days of receipt. If a complaint requires longer processing time, the consumer will receive confirmation and an expected response time.


Article 15 – Disputes

All agreements between the trader and the consumer to which these terms relate are governed by Dutch law, unless mandatory consumer law provides otherwise.
